WHEREAS, the County of Cumberland Purchasing Department properly advertised fair and open proposals to furnish and deliver professional services for litigation services for the County of Cumberland in accordance with N.J.S.A. 19:44A-20.4 et seq. and the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and

WHEREAS, sealed proposals were received and read for furnishing and delivering professional services for litigation in accordance with said proposals; and

WHEREAS, the following law firms were awarded authorization to provide legal services for litigation on behalf of the County of Cumberland:


Barker, Gelfand & James (now known as Barker, Gelfand, James & Sarvas, P.C.)

                                          Birchmeier & Powell LLC

                                          Blaney & Karavan, PC

                                          Brown & Connery, LLP

                                          Chance & McCann

                                          The Garty Law Firm, LLC

                                          Florio Perrucci Steinhardt & Fader, LLC

                                          Grace Marmero & Associates, LLP

                                          Kavanagh & Kavanagh, LLC

                                          Louis Charles Shapiro, P.A.

                                          Testa Heck Testa & White, P.A.

                                          Weir & Partners LLP

; and

              WHEREAS, a maximum contract award amount was set forth in the resolution of $50,000.00; and

              WHEREAS, pursuant to regulations contained in N.J.S.A. 5:30-5.3 through 5:30-5.5, it is required that a monetary ceiling for services of a vendor be specified in the awarding resolution; and

              WHEREAS, Resolution 2018-73 specifies a maximum contract award amount of $50,000.00 which was in the aggregate for the aforesaid vendors; and

              WHEREAS, the Board of Chosen Freeholders of the County of Cumberland is desirous of amending Resolution 2018-73 to clarify that the initial contract amount for each vendor shall be in the amount of $5,000.00; and

              WHEREAS, the initial authorization of a $5,000.00 ceiling for each law firm is intended to be an individual authorization for each law firm with respect to continuing matters and for new matters being handled by or assigned to such law firms; and

              WHEREAS, the aforesaid regulations require that the ceiling for legal expenditures be increased from time to time by resolution of the governing body; and

              WHEREAS, the aforesaid regulations require that any new matters assigned to the aforesaid law firms or vendors must be awarded by separate resolutions specifying the initial ceiling for legal expenditures.


1.              That Resolution 2018-73 be and is hereby amended and corrected to reflect that the initial ceiling for legal expenditures with respect to the contractors identified herein shall be $5,000.00 for each continuing legal matter or new matter assigned and that any additional increase of a ceiling for expenditure of legal expenses to the foregoing law firms handling continuing legal matters on behalf of the County of Cumberland shall be made from time to time as necessary by resolution in accordance with N.J.A.C. 5:30-5.3 through 5:30-5.5.

2.              That any additional new work shall be assigned by separate resolution to any law firm identified herein which is assigned a new matter on behalf of the County of Cumberland together with a specification of the ceiling for the expenditure of legal services which must be amended, as necessary from time to time.

3.              That in all other respects, Resolution 2018-73 remains unchanged and in full force and effect.

Passed and adopted at a regular meeting of the Board of Chosen Freeholders held at the Cumberland County Administration Building, 164 West Broad Street, Bridgeton, New Jersey on Tuesday, February 27, 2018 at 6:00 p.m. prevailing time.
