WHEREAS, the County of Cumberland advertised seeking fair and open proposals to furnish and deliver professional services for legal services as defense counsel for the Cumberland County Workers Compensation Program in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and N.J.S.A. 19:44A-20.4 et seq.; and

WHEREAS, those proposals were received and read and the law firms identified herein were approved to perform legal services on behalf of the County of Cumberland as aforesaid; and

WHEREAS, new regulatory provisions contained in N.J.A.C. 5:30-5.3 through N.J.A.C. 5:30-5.5 require that contracts for such services contain an upper limit of monetary value for such services; and

WHEREAS, the aforesaid regulations also require that the ceiling with respect to the limit of monetary services being provided by a contractor must be increased in the event that services are anticipated to exceed the initial monetary level of services specified in the resolution; and

WHEREAS, Resolution 2018-71 is in need of amendment due to the monetary level for all of the contractors appearing to be in the aggregate; and

WHEREAS, a separate resolution will be enacted upon when individual assignments for work are made to the successful contractors which resolutions may be amended from time to time setting forth a monetary limit for the provision of legal services; and

WHEREAS, the Board of Chosen Freeholders of the County of Cumberland is desirous of amending Resolution 2018-71 to specifically set forth an initial monetary level for the rendering of legal services in connection with the defense of workers compensation matters on behalf of the County of Cumberland.


1.              That to the extent that Resolution 2018-71 sets forth a maximum contract award in the amount of $10,000.00 in the aggregate for the law firms identified therein, said resolution is amended to reflect that each law firm shall be initially entitled to charge not to exceed $3500.00 in connection with the rendering of legal services for the defense of workers compensation matters on behalf of the County of Cumberland.

2.              That identification of a $10,000.00 aggregate ceiling for the provision of legal services by the law firms hereinafter set forth is hereby deleted and rescinded.

3.              That upon assignment by resolution of individual matters to each of the law firms hereinafter set forth an amount to be specified as a monetary ceiling shall be set forth therein, which may be amended from time to time in accordance with N.J.A.C. 5:30-5.3 through N.J.A.C. 5:30-5.5.

4.              That the law firms awarded authorization to perform workers compensation defense services in accordance with Resolution 2018-71 are:

5.              That in all other respects, Resolution 2018-71 remain unchanged and in full force and effect.

Passed and adopted at a regular meeting of the Board of Chosen Freeholders held at the Cumberland County Administration Building, 164 West Broad Street, Bridgeton, New Jersey on Tuesday, February 27, 2018 at 6:00 p.m. prevailing time.
