Resolution Affirming Emergency To Exist At The Cumberland County Department Of Corrections Regarding Boiler No. 2 And Affirming The Repair Thereof

WHEREAS, on November 9, 2017, an emergency developed at the Cumberland County Department of Corrections causing failure of Boiler No. 2 with multiple mechanical issues including a bad control and several safety valves that were leaking; and

WHEREAS, bringing the boiler back on line in its current condition would have assuredly lead to further problems; and

WHEREAS, if Boiler No. 2 was not repaired and kept offline, we would have risked putting a grave strain on the boiler which was operable and if that boiler were to go down, we would have been out of heating completely for the entire Jail which would have posed both a security and health risk for the staff and inmate population since it was reported we would be getting extended days of cold weather being 22 degrees on Friday night and 30 degrees for Saturday into Sunday; and

WHEREAS, we also would have been in violation of NJDOC 10a Administrative Code - to be without heating for the inmate population; and

WHEREAS, since there was no current contract in place for Boiler Repair/PM and State contract vendors are not authorized by the manufacturer to work on this brand boiler, a purchase order was created to have DelVal Equipment Corp., 604 General Washington Ave., Norristown, PA  19403-3552 perform the emergent services and repair Boiler No. 2 at the Jail; and

WHEREAS, N.J.S.A.. 40A:11-6 allows a contracting unit to award contracts without public advertising for bids for the immediate delivery of services under said emergency condition.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF CUMBERLAND, as follows:

1.              That for the reasons set forth in the preamble hereto, this board hereby affirms an emergency to have existed.

2.              That this Board hereby further affirms the actions taken to correct said emergency situation from a public safety standpoint.

3.              That said repair shall be charged to Line Item Appropriation or Account No. 7-01-24-759-203-303 in the amount of $9,425.76.
