Body

WHEREAS, the County of Cumberland has a need to provide licensed mental health counseling services for the Cumberland County Alcohol and Drug Abuse Office as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4 and 20.5 and is exempt from public bidding under 40A:11-5(1)(a)(i) as a professional service; and

WHEREAS, the Director of Purchasing has determined and certified in writing that the value of the acquisition will not exceed $25,000.00; and

WHEREAS, the anticipated term of this contract is January 1, 2018 through December 31, 2018; and

WHEREAS, James Gregory, MA, LPC, CCS, 2209 Olive Lane, Millville, NJ  08332  has submitted a proposal dated indicating he will provide the aforesaid services; and

WHEREAS, James Gregory, MA, LPC, CCS has completed and submitted a Business Entity Disclosure Certification which certifies that he has not made any reportable contributions to a political or candidate committee in the County of Cumberland in the previous one year, and that the contract will prohibit him from making any reportable contributions through the term of the contract; and

WHEREAS, the maximum contract award renewal amount is $25,000.00; and

WHEREAS, no amount will be encumbered until such time as good or services are ordered; and

WHEREAS, the Purchasing Agent and/or CFO/Treasurer shall ascertain that there are available sufficient uncommitted appropriations to provide payment; and

WHEREAS,  the purchase order will encumber appropriate account numbers as determined by the CFO/Treasurer at the time the purchase order is created in an amount(s) not to exceed the maximum contract of $25,000.00 in the aggregate and the contract award shall be contingent upon appropriation of sufficient funds in the 2018 temporary and/or permanent Budgets.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CHOSEN FREEHOLDERS  OF THE COUNTY OF CUMBERLAND, as follows:

1.                  That the Director and Clerk of this Board are hereby authorized and directed to enter into a contract with James Gregory, MA, LPC, CCS as described herein for the contract period January 1, 2018 through December 31, 2018.

2.              That the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution.

3.               That said project shall be charged to Line Item Appropriation or Account No. 8-01-27-789-201-624 contingent upon appropriation of the 2018 Budget.

4.              That notice of this “non-fair and open” award shall be printed in the designated official newspapers.

Passed and adopted at a regular meeting of the Board of Chosen Freeholders held at the Cumberland County Administration Building, 164 West Broad Street in Bridgeton, New Jersey on Tuesday, November 28, 2017 at 6:00 p.m., prevailing time.
