              WHEREAS, the Cumberland County Board of Chosen Freeholders has established the Cumberland County Agricultural Development Board ("CCADB") pursuant to the N.J. Agriculture Retention and Development Act, N.J.S.A. 4:1C-11 et seq., to oversee the implementation of the County Farmland Preservation Program and make recommendations on farmland preservation issues to this Board; and

              WHEREAS, the Act provides for the purchase of development rights for the permanent preservation of productive agricultural land and to compensate the owners thereof; and

              WHEREAS, the County of Cumberland submitted a Planning Incentive Grant (“PIG”) Application to the State Agriculture Development Committee pursuant to the State Agriculture Retention and Development Act, N.J.S.A. 4:1C-11 et seq., the Planning Incentive Grant Program, N.J.S.A. 4:1C-43.1 et seq., and the regulations thereunder; and

              WHEREAS, the application provided for the proposed acquisition of a Development Easement on property owned by Anthony Sparacio, Jr. and Anthony Sparacio, III on Big Oak Road, and known as Deerfield Township block 4, lot 40; and

              WHEREAS, the State Agriculture Development Committee certified the fair market value of the aforementioned development easement pursuant to N.J.A.C. 2:76-7.14 at $5,000.00 per acre, which has been accepted by the applicant; and

              WHEREAS, the County of Cumberland, in participation with the New Jersey Conservation Foundation (NJCF), has requested to utilize United States Department of Agriculture, Natural Resources Conservation Service Federal Farm and Ranch Lands Protection Program (FRPP) grant funding and Open Space Conservancy (OSC) grant funding to further leverage available County funding for farmland preservation;

              WHEREAS, the estimated cost sharing breakdown for the acquisition of the development easement prior to the consideration of FRPP and OSC funding is as follows (based on an estimated 12 net acres), subject to the actual acreage to be covered by the development easement per the final survey which conforms to the farmland preservation program requirements:

              State Agriculture Development Committee                            $40,800.00

                            ($3,400.00/per acre: 68.00%)

              County of Cumberland                                                        $19,200.00

                            ($1,600.00/per acre: 32.00%)

              WHEREAS, the aforementioned approximate cost share breakdown may be amended to include FRPP and OSC grant funds with the intent of reducing direct County funding;

              WHEREAS, this application has been reviewed and approved by the CCADB, as set forth in its Resolution duly adopted on October 10, 2017, a copy of which is attached hereto.

              NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OF CUMBERLAND, as follows:

              1.  That this Board hereby grants approval of the purchase of the development rights of the aforementioned property pursuant to N.J. Agriculture Retention and Development Act subject to final approval of the State Agriculture Development Committee and adequate State appropriations.

              2.  That said application shall be forwarded to the State Agriculture Development Committee for consideration for final approval.

              3.  That the Director and Clerk of this Board are hereby authorized and directed to execute contracts of sale with said owner and other such documents as may be necessary to complete this transaction in the forms on file with the Clerk of this Board.

              4.  That upon receipt of Open Space Conservancy and/or Federal Farm and Ranch Lands Protection Program funding, if any, such funds may be applied to the aforesaid development easement purchase in such amounts and in such proportions as determined by the Cumberland County Agriculture Development Board to maximize the use of county funding for additional future conservation easements or property acquisitions.

Passed and adopted at a regular meeting of the Board of Chosen Freeholders held at the Cumberland County Administration Building, 164 West Broad Street, Bridgeton, New Jersey on Tuesday, October 24, 2017 at 6:00 p.m. prevailing time.
